AMILY MCCOOL

Traffic Lawyer

I’ve always been driven by work that furthers social justice. For my entire career, both as a social worker and an attorney, I have worked to assist those who have the least. I am passionate about defending those charged with crimes, helping people expunge their criminal records, and assisting those affected by violence.

I was motivated to attend law school after witnessing how the court system left both victims and defendants behind and failed to support families in becoming places of safety. After law school, I worked at the Wake County District Attorney’s Office for four years. As an assistant district attorney, I specialized in prosecuting domestic violence cases both in district and superior court. I conducted countless trials and built my skills in analyzing and presenting cases to judges and juries.

I left prosecution to continue to assist families by serving as a domestic violence attorney for Legal Aid of North Carolina in Durham, representing victims of domestic violence in civil matters who otherwise could not afford an attorney. I then worked at the state level for four and a half years as the Legal & Policy Director of the NC Coalition Against Domestic Violence. In that role I trained criminal justice stakeholders including law enforcement, prosecutors, magistrates, clerks, crisis agency advocates, and other allied professionals all across the state. I also worked to improve NC’s laws by collaborating with legislators to pass new legislation to assist in strengthening families.

I am an LGBTQ-affirming attorney and understand the additional complications that LGBTQ-identified folks face when interacting with the court system. In addition to expungement, criminal defense and restraining order representation, I am available to assist clients seeking name changes and/or gender identity marker changes and to help explain the process for them through trauma-informed representation.

Why You Might Need the Best Traffic Attorney:

  1. Legal Expertise: Traffic laws and regulations can be complex and vary from jurisdiction to jurisdiction. The best traffic attorneys have specialized knowledge of local traffic laws and can navigate the legal intricacies of your case.

  2. Reducing Penalties: An experienced attorney can often negotiate with prosecutors to reduce the severity of penalties associated with traffic violations, such as fines or points on your driving record.

  3. Protecting Your Driving Record: Accumulating too many points on your driving record can lead to increased insurance rates and even the suspension of your driver’s license. A traffic attorney can help you minimize the impact on your record.

  4. Avoiding License Suspension: For serious offenses, your driver’s license may be at risk of suspension. A skilled attorney can advocate on your behalf to help you keep your driving privileges.

  5. Defending Your Rights: A traffic attorney can protect your legal rights, ensuring that law enforcement followed proper procedures during the traffic stop and that your rights were upheld.

  6. Courtroom Representation: If your case requires a court appearance, an attorney can represent you effectively in court, presenting your case, cross-examining witnesses, and arguing in your favor.

Duties and Responsibilities of a Traffic Attorney:

  1. Case Evaluation: The attorney reviews the details of your traffic violation, including the circumstances of the incident and any evidence against you.

  2. Legal Advice: They provide legal counsel, explaining the potential consequences of the violation, your options, and potential strategies for your defense.

  3. Evidence Review: Attorneys assess the evidence against you, looking for any procedural errors or weaknesses in the case that can be used in your defense.

  4. Negotiation: If possible, the attorney can negotiate with prosecutors to reach a plea agreement that minimizes the penalties you face.

  5. Court Representation: If your case goes to court, the attorney represents you before a judge, presenting your case, cross-examining witnesses, and advocating on your behalf.

  6. Legal Documentation: Attorneys handle the preparation and submission of legal documents, such as motions and pleadings, required for your defense.

  7. Advice on Plea Options: Attorneys can advise you on whether to accept a plea deal or contest the charges in court based on the strengths of your case.

  8. Traffic School: In some cases, attending traffic school can help mitigate the consequences of a violation. Attorneys can guide you on whether this is a viable option.

  9. Expert Witness: If necessary, attorneys can call upon expert witnesses to provide testimony in support of your case.

  10. Guidance on Next Steps: Attorneys guide you on the steps to take after your case is resolved, including any actions needed to comply with court orders or penalties.
