Kelly McClure

Family Lawyer

As an experienced family law attorney with a career spanning more than 25 years, I have a deep-rooted passion for protecting the relationships, finances, homes, and businesses of the families I represent. I believe in helping people navigate through what is unarguably one of the most difficult chapters of their lives as seamlessly and successfully as possible while ensuring a solution that is tailored to meet the needs of each individual client.

  • Represented a CEO of a multimillion-dollar company in his premarital agreement prior to marriage, which ultimately led to successful confirmation of separate property businesses upon divorce at highly contested trial. At same trial obtained primary possession of his child for dad despite mom being the stay at home parent.
  • Achieved disproportionately favorable divorce settlement for reality television star who was also the wife of a star professional athlete.
  • Obtained custody for working professional father.

Francesca Blackard

Family Lawyer

I pride myself on getting to know each client on a personal level to really understand their goals whether it be in a divorce suit, child custody case, or in negotiating a pre-marital agreement. As abstract as those goals may be, it is important for an attorney to never lose sight of them in the heat of litigation/negotiation/mediation/collaboration.

  • Secured primary possession for a grandparent seeking custody of a grandchild.
  • Negotiated a 50/50 possession schedule for a parent who had previously signed away custody rights in the heat of a divorce.
  • In first month at firm, briefed the Court on complex division of a medical practice leading to favorable judgment.
  • Negotiated post-marital agreement to save marriage; marriage ultimately ended in amicable divorce a few years later with no disputes.

Immediate Legal
Advice

A family lawyer plays a crucial role in handling legal matters that involve family relationships and domestic issues. Here are some key roles and responsibilities of a family lawyer:

  1. Divorce and Separation: Family lawyers assist individuals in navigating the process of divorce or separation. They provide guidance on legal requirements, help negotiate settlements regarding division of assets, child custody, visitation rights, and spousal support. They can also represent clients in court proceedings if the divorce becomes contested.

  2. Child Custody and Support: Family lawyers help clients establish child custody arrangements and work towards protecting the best interests of the children involved. They assist in developing parenting plans, determining visitation schedules, and ensuring that child support obligations are fair and properly enforced.

  3. Adoption and Guardianship: Family lawyers assist individuals or couples with the legal processes involved in adoption or guardianship. They help navigate through the necessary paperwork, ensure compliance with adoption laws, and represent clients in court during adoption proceedings.

  4. Paternity Issues: In cases where paternity needs to be established, family lawyers can guide clients through the legal procedures involved. They help with DNA testing, filing petitions to establish paternity, and addressing related matters such as child custody and support.

  5. Domestic Violence and Restraining Orders: Family lawyers offer support to individuals facing domestic violence or abuse. They help clients obtain restraining orders or protective orders, provide advice on legal options and resources available for their protection, and represent them in court during hearings related to these matters.

  6. Pre-nuptial and Post-nuptial Agreements: Family lawyers assist couples in drafting and negotiating pre-nuptial or post-nuptial agreements. These agreements define the division of assets, spousal support, and other matters in the event of separation, divorce, or death. Family lawyers ensure that these agreements are legally binding and protect their clients’ interests.

  7. Estate Planning: Family lawyers often assist clients in creating comprehensive estate plans. They help draft wills, establish trusts, designate beneficiaries, and plan for the distribution of assets after death. Family lawyers ensure that the wishes of their clients regarding their estate are legally documented and properly executed.

  8. Mediation and Alternative Dispute Resolution: In many family law cases, family lawyers act as mediators or participate in alternative dispute resolution processes. They facilitate negotiations between parties, helping them reach mutually acceptable agreements outside of court. This approach can be less adversarial, time-consuming, and costly than traditional litigation.

Overall, the role of a family lawyer is to provide legal advice, guidance, and representation in matters related to family and domestic issues. They strive to protect their clients’ rights, advocate for their best interests, and help navigate the legal complexities involved in these sensitive matters.
