Overall, I have always had a deep respect for the justice system but discovered that the legal representation for individuals arrested for DWI was less than desirable upon being arrested for a mistaken belief that I was driving while impaired. I was pulled over for not having my lights on, and that, amongst other patently false observations, led the officer to presume I was intoxicated. Though I had a BAC merely above 0 and was soon released without charge, this was an experience that led me to witness, first-hand, the DWI legal support realities for people who are charged with a DWI.

Eric H. Anderson

Eric H. Jon Geffen graduated from William Mitchell College of Law with honors in 1997. During law school, Jon worked as an investigator for the Minnesota Department of Human Rights investigating discrimination charges. After graduating, Jon accepted a position as a staff attorney at Southern Minnesota Regional Legal Services (“SMRLS”), the legal aid office in St. Paul. For nearly the next decade, Jon represented clients in matters including social security disability, unemployment, welfare rights, medical assistance, health licensing, and criminal expungements.

Driver’s License Restrictions for DWI in Minnesota

In Minnesota, a DWI (Driving While Intoxicated) conviction can result in various restrictions being placed on a driver’s license, depending on the severity of the offense and whether it’s a first-time or repeat violation. Below are some common driver’s license restrictions for DWI offenders in Minnesota:

1. Limited License

  • After a DWI conviction, you may be eligible for a limited license, also known as a “work permit.” This allows you to drive only for specific purposes, such as going to and from work, school, treatment, or attending court-ordered programs. The limited license typically comes with time restrictions, limiting driving to specific hours each day.

2. Ignition Interlock Device Program

  • For repeat offenders or those with high blood alcohol content (BAC), the state may require the installation of an Ignition Interlock Device (IID). This device prevents the vehicle from starting if alcohol is detected on the driver’s breath. Offenders need to use the device for a certain period before fully reinstating their license.

3. No Alcohol Consumption

  • Some drivers may have a “No Alcohol Consumption” restriction placed on their license. This means they cannot consume any alcohol while operating a vehicle or at any time, as alcohol testing might be required.

4. License Suspension or Revocation

  • Suspension or revocation of the driver’s license is one of the primary penalties for DWI in Minnesota. For first-time offenders, the suspension period can last between 90 days to 1 year, depending on BAC levels and other factors. For repeat offenders, the revocation period can last up to 3 years or longer.

5. Restricted License (B-Card)

  • Offenders who have had multiple DWI convictions might be issued a Restricted License (also called a B-Card), which permanently prohibits the individual from consuming any alcohol. If they violate this restriction, their driving privileges may be immediately revoked.

6. License Reinstatement Requirements

  • To reinstate a suspended or revoked license after a DWI, individuals must complete several steps, including a DWI knowledge test, chemical dependency assessment, and sometimes an alcohol treatment program. A reinstatement fee must also be paid.

Minnesota takes DWI offenses seriously, and the penalties become more severe with each subsequent violation. The specific restrictions vary, but the goal is to prevent further impaired driving and promote rehabilitation.
