Divorce Lawyers
Choosing your Divorce or Family Law Attorney is an important decision. There are so many lawyers that making the right choice can be difficult. Let me make that decision easy for you. Retain the attorney that you trust, that understands what your case is all about, what are your goals, has true settlement and courtroom experience, that listens to you, explains the law and with whom you are confident.
Over the past 40 years as an attorney, my goal for each and every client is beyond winning (if that word truly exists in Matrimonial Law) but to make sure that every client knows that I gave their case 100% and that they believe they had the best possible representation.
I have formed long term relationships with clients that have lasted beyond their cases. One of my friends of over 20 years was a divorce client first and then became a close personal friend. I have clients that I have represented years ago who will refer their friends, co-workers and family to me and nowhere else. The ability to develop and maintain a relationship with a current client is so important because the advice that I give comes from my knowledge of the law and desire to help solve problems. My job is to reduce the anxiety and worries that are part of every matrimonial case.
Education & Experience
For the past 30+ years of my 40 year career, I have practiced Divorce and Family Law exclusively. I received my Bachelor of Arts degree from Franklin & Marshall College in 1978 and graduated from the Benjamin Cardozo School of Law of Yeshiva University with my Juris Doctor degree in 1981.
I have represented over 3,000 clients in Matrimonial and Family Law matters.
I have tried cases to conclusion involving almost every issue that can arise between divorcing parties and/or non-married parties with a child in common. I have obtained awards of counsel fees for my clients based upon written decisions of the Court. Prior to trying any case, serious efforts are always made to negotiate a settlement. However, when a case cannot be settled, I will try your case.
I have previously served as a volunteer arbitrator in the Civil Court of the City of New York, Small Claims Part and was appointed by a Supreme Court Justice to serve as a Referee of a bitterly contested matrimonial deposition. Prior to concentration in Matrimonial and Family Law matters, I worked in several law firms and handled personal injury matters, real estate closings, drafting and probating of wills and general commercial litigation.
ROBERT H. MONTEFUSCO
Divorce Lawyers
Robert H. Montefusco has been practicing law since 1998 and concentrates in the areas of matrimonial and family law. He is a very experienced and determined trial attorney, having conducted hundreds of trials and/or hearings.
Mr. Montefusco graduated cum laude from Touro Law School. He was a recipient of the American Excellence Award for Family Law and Evidence, a member of the Dean’s List and an editor of Touro Law Review. He is a former prosecutor for the Suffolk County District Attorney’s Office, where he gained invaluable experience in the courtroom not otherwise available to private practitioners.
On a personal note, Mr. Montefusco was involved in a very acrimonious divorce and, rather than focusing on the hardship and emotional pain of his contested divorce action which resulted in a trial, he believes that this experience was an opportunity for him to learn how to be a more compassionate and effective attorney. He intimately understands what it takes to be successful in divorce litigation, and can sympathize with what you may be experiencing.
Commitment to Community
Outside the courtroom, Mr. Montefusco augments his education by routinely attending Continuing Legal Education seminars on the latest updates and trends in the law. He is an active participant in the Suffolk County matrimonial bar mentoring program, providing legal advice to less experienced attorneys.
He has been a guest lecturer at Touro Law Center relating to issues of criminal procedure and practice and has been featured in Touro Law Center’s recruiting literature. He has also appeared on News12 and has been quoted in various newspapers.
Mr. Montefusco is admitted to practice in New York State and the United States District Court for the Eastern District of New York.

I know from both personal and professional experience that divorce is emotional for everyone involved. No one expects to get divorced so it is naturally a stressful life-changing event. I’ve been in your shoes; I understand.
As emotional as it is, divorce is also a practical matter. While it may seem cold, when it comes down to it, divorce is essentially a legal “business transaction”. My job as your divorce attorney is to take care of the practical, material and legal aspects of your divorce so you can move on emotionally.
I’m here to protect your legal and financial interests now and ensure you have the tools and resources you need to start a new, happy, productive, fulfilling life without your current spouse.
While my greatest job satisfaction is the relief I bring to my clients, below are some of the credentials, awards and recognition I’ve received en route.

Having the best divorce lawyer in Suffolk County, NY, can offer several advantages:
Expertise in New York Family Law: The best divorce lawyers in Suffolk County will have a deep understanding of New York’s family laws and regulations, including those related to divorce, child custody, property division, and spousal support.
Local Court Knowledge: They will be familiar with the Suffolk County court system, judges, and local procedures. This familiarity can be invaluable in predicting how your case may be handled and in effectively navigating the legal process.
Strategic Planning: A top divorce lawyer will develop a tailored strategy based on your unique circumstances, considering factors such as assets, liabilities, children, and your specific goals for the divorce.
Negotiation Skills: Many divorces are settled through negotiations. A skilled lawyer will be an effective negotiator, working to achieve the best possible outcome for you in terms of property division, alimony, child support, and custody arrangements.
Emotional Support and Objectivity: Divorce is an emotionally charged process. A seasoned attorney can offer objective guidance, helping you make rational decisions and navigate the emotional challenges.
Legal Paperwork and Procedures: A divorce involves a significant amount of paperwork, filings, and deadlines. A knowledgeable lawyer will ensure that all necessary documents are prepared correctly and submitted on time.
Alternatives to Divorce:
Legal Separation: This allows couples to live separately while remaining legally married. It can address issues like property division, spousal support, and child custody, but without officially terminating the marriage.
Mediation: In mediation, a neutral third party (the mediator) helps couples communicate and reach agreements on issues like property division, child custody, and support. This can be a more cooperative and less adversarial approach than traditional litigation.
Collaborative Divorce: In a collaborative divorce, each spouse has their own attorney, but the process is focused on negotiation and settlement rather than litigation. It often involves other professionals like financial advisors and therapists.
Arbitration: This involves hiring a neutral third party (the arbitrator) who acts like a private judge. The arbitrator makes decisions on the issues in dispute, and these decisions are legally binding.
Annulment: An annulment legally voids a marriage, essentially treating it as if it never happened. This is different from divorce, which ends a valid marriage.
Marriage Counseling or Therapy: Seeking professional help to improve communication and resolve issues in the marriage can be an alternative to divorce.
It’s important to consult with a legal professional to understand which option is best suited to your specific situation. Keep in mind that the availability and suitability of these alternatives may vary based on jurisdiction and individual circumstances.
